Real estate expertise for divorce and separation

During a divorce or separation, the value of your real estate determines the division of your assets. An impartial expertise report, prepared by a certified expert, protects your interests and speeds up the process.

Why have your property appraised during a divorce?

In divorce proceedings, jointly owned real estate must be valued to determine compensatory payments, buyout amounts, or division terms. Unlike a simple agency valuation, an expertise by a certified expert is a formal document, enforceable before the family court judge.

The financial stakes are often considerable: a 10% error on the value of a 400,000 euro house represents 40,000 euros at stake in the division.

Using an independent expert, who has no interest in selling the property, guarantees an impartial valuation.

How does the expertise proceed in a divorce?

01

Initial contact and mission scoping

One spouse, both jointly, their lawyer or notary contacts us. Together we define the scope: which properties to value, the reference date, and the timeline.

02

Property visit

We visit each property to be valued. The visit can take place with both spouses or separately. We conduct a complete survey: surfaces, condition, amenities, environment.

03

Market study and report writing

We analyze recent comparable transactions and apply appropriate valuation methods. The detailed report is written with reasoned conclusions and supporting annexes.

04

Report delivery

The report is delivered to you and your lawyer or notary. We remain available to explain it to any party, including before the judge if necessary.

Buyout payment and compensatory allowance

If one spouse wishes to keep the family home, they must buy out the other's share. The buyout amount depends directly on the property's market value.

For compensatory allowance, the family court judge considers each spouse's real estate assets. An expertise report provides a solid basis for their decision.

The advantage of an expert who knows your market

National expertise firms often send an expert unfamiliar with your area. At Alpaca Immobilier, we live and work in north Montpellier.

As a real estate agency, we see transactions happening daily. Our comparisons reflect local market reality.

Frequently asked questions

Do both spouses need to agree to request an expertise?
No. Either spouse can commission their own expert. However, a jointly requested expertise carries more weight as it is accepted by both parties from the start.
What is the reference date for the valuation?
Generally, it is the date of divided enjoyment set by the judge, often the date of the non-conciliation order. We adapt the reference date to your situation.
